Terms of Service — OFMAI

OFMAI (the "Platform") is an AI content creation service provided by MANTRA AI TECHNOLOGIES ("we", "us", "our"). By accessing the Platform or using our artificial-intelligence generation services, you agree to be bound by these Terms of Service. If you do not agree, you must immediately cease using the Platform.

Access to OFMAI is reserved for natural persons who are of legal age in their country of residence, and in any event at least 18 years old. This minimum age requirement applies because the Platform processes likeness data and image rights, which require legal capacity to consent. By using the service, you formally declare under your sole responsibility that you are of legal age and legally authorized to enter into this agreement.

3.1 Principle The Platform allows you to upload reference images to train a custom AI character that consistently represents a person's likeness across generated content. 3.2 Mandatory user guarantees By uploading an image of any person, you formally guarantee under your SOLE and ENTIRE responsibility: (a) Either that you are the person represented in the image; or (b) That you have obtained the express, free, informed, specific and WRITTEN consent of each identifiable person to use their likeness for AI-generated content. You acknowledge that the absence of such consent constitutes a serious offense. 3.3 Strict prohibitions It is FORMALLY FORBIDDEN to import or use the Platform to create content: - Depicting real persons without their express written consent - Using the likeness of public figures, celebrities, influencers, politicians, or any identifiable person without their authorization - Imitating or impersonating a real person ("look-alike", "deepfake") - Involving or simulating minors, regardless of the technique used - Of a violent, hateful, discriminatory, or unlawful nature - For the purpose of harassment, defamation, blackmail, or any other malicious purpose You also undertake not to distribute, share, commercialize, or make public any such prohibited content. 3.4 Penal sanctions You are expressly informed that, under French and comparable legislation: - The creation of a visual montage depicting a person without their consent is punishable by 2 years imprisonment and a €60,000 fine (Article 226-8 of the French Penal Code) - The distribution of such content is punishable by 3 years imprisonment and a €75,000 fine - These penalties are aggravated in certain circumstances (minor, vulnerable person, large-scale distribution) These sanctions apply regardless of the author's nationality or the platform's hosting location, provided that a victim is in France or the content is accessible there. 3.5 Prevention measures To prevent abusive uses, OFMAI implements technical measures (reinforced warnings, complete traceability, automated detection, digital marking, rate-limiting). 3.6 Consequences of violations Any violation of the above prohibitions results IMMEDIATELY and WITHOUT NOTICE in: suspension or permanent deletion of the account, deletion of content, blocking by fingerprint, retention of logs, reporting to authorities, and legal proceedings.

4.1 OFMAI's role OFMAI provides an artificial-intelligence technical solution allowing users to generate personalized visual content. Our role is strictly limited to: - Making available the technical infrastructure and algorithms - Providing storage for uploaded and generated files - Ensuring the technical functioning of the service OFMAI exercises no prior editorial control over imported files, prompts, or generated content. 4.2 User's exclusive responsibility The user is SOLELY and ENTIRELY responsible for the lawfulness of files they import, respect for third-party rights, obtaining consents, content generated via the Platform, and their usage. 4.3 Liability regime In accordance with the regime applicable to hosting providers and technical service providers (LCEN, DSA), OFMAI's liability can only be engaged on the condition that we have had actual knowledge of the manifestly unlawful nature of specific content AND that we have not acted promptly to remove it. 4.4 Commercial use OFMAI authorizes the commercial use of content generated by the user, subject to compliance with these terms, third-party rights, and the user's entire responsibility.

5.1 Reporting mechanism In accordance with the Digital Services Act (DSA), OFMAI provides several reporting channels: - Online form: https://ofmai.ai/report - General email: [email protected] - Priority email for image-rights and consent violations: [email protected] - Emergency contact for victims: [email protected] Please provide a precise description, the reason, your contact details, and any useful evidence. 5.2 Processing of reports OFMAI commits to acknowledging receipt within 24 business hours. Image-rights and consent-violation reports are processed with priority (12h max). 5.3 Trusted flaggers OFMAI cooperates with trusted flaggers designated by Arcom. 5.4 Cooperation with authorities OFMAI responds to requisitions from competent judicial and administrative authorities.

The User agrees to guarantee, indemnify, and hold harmless OFMAI, its officers, and employees against any complaint, legal action, loss, damage, or cost (including legal fees) arising from: - The User's violation of a third party's rights (right to image, privacy, intellectual property) - The absence of consent from a real person whose likeness is used for AI generations - Any unlawful or fraudulent use of the Platform's services This indemnification covers notably (but not exclusively): - Upload of files representing a person without their consent - Generation of content impersonating others - Distribution or commercialization of content violating third-party rights - Use of the Platform for harassment, defamation, or any malicious purpose - Any violation of the prohibitions stated in Article 3

All rights to the technology, algorithms, and interface of the Platform remain the exclusive property of OFMAI. The User retains rights to the generated media, provided they do not violate any third-party rights.

Due to the immediate provision of digital content and AI computing power, the User expressly agrees that the performance of the service begins immediately upon payment. Consequently, in accordance with consumer-protection laws (Article L221-28 of the French Consumer Code or equivalents), no right of withdrawal or refund applies once the service has been accessed or credits have been consumed.

The service is provided "as is". OFMAI does not guarantee that the service will be uninterrupted or error-free. We shall not be held liable for indirect damages, loss of revenue, or damage to reputation resulting from the use of the Platform.

These terms are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of the registered office of the company publishing OFMAI.

Personal data collected and processed by OFMAI is handled in accordance with the General Data Protection Regulation (GDPR) and applicable legislation. COLLECTED DATA: - Account data: email, username, payment information - Technical data: IP address, device fingerprint, connection logs - Usage data: uploaded files, prompts, generated content, action history PURPOSES: Contract execution, abuse prevention, legal-obligation compliance, service improvement. RETENTION: - Account data: subscription duration + 12 months - Technical and usage logs: 12 months minimum (legal obligation) - Reported content: until dispute resolution + 12 months USER RIGHTS: Right of access, rectification, erasure, limitation, opposition, portability. TRANSFERS OUTSIDE EU: Data may be processed or stored outside the EU in compliance with appropriate guarantees.
